Investigations
Wittliff Cutter is experienced in helping companies navigate investigations involving highly sensitive matters. We have counseled private and public companies through many different types of internal investigations, including employment matters, regulatory inquiries and due-diligence related investigations. Our partners understand how to conduct and complete high-stakes investigations in a cost-effective manner that is discrete, thorough, and that mitigates business disruption.
Wittliff Cutter’s partners have successfully managed numerous internal investigations. We have experience investigating highly-confidential, sensitive employment matters; responding to and investigating corporate practices in connection with regulatory inquiries by state and federal agencies; and conducting time-sensitive internal investigations necessary to complete business transactions. We have represented private and public companies and individuals in connection with investigations by the EEOC, FINRA, SEC, and various state attorneys general and Texas’ state agencies. Among our partners, we have former prosecutors and senior officials at the Texas Attorney General’s office, who use their experience and reputation to interact and negotiate credibly with government regulators.
Government Enforcement Actions
Increasingly, regulatory agencies like the Federal Trade Commission, the Department of Health and Human Services, the SEC, and state attorneys general are scrutinizing companies’ business activities and investigating potential violations of state and federal consumer protection and privacy laws. Wittliff Cutter’s partners include a former federal prosecutor and the founding Division Chief of the Texas Attorney General’s cybercrime division. We are well equipped to handle internal investigations, responding to CID’s and regulatory subpoena, negotiating settlements, and defending enforcement actions.
White Collar Criminal Defense
Our attorneys have defended companies and individuals being investigated or prosecuted for a wide variety of violations including fraud, criminal infringement of copyrights and conspiracy. We often assist companies in defending government investigations, including assisting with responding to civil process and criminal grand jury subpoenas.
