Matthew Gates has over a decade of experience in commercial litigation, with a focus on intellectual property matters. He has represented companies of all sizes in high-stakes patent infringement cases in courts across the United States, as well as investigations before the International Trade Commission. Matt also has extensive experience addressing complex commercial matters, including trade secret misappropriation, contract and licensing disputes, antitrust matters, and design and manufacturing defect cases for Fortune 500 companies. Regardless of subject matter, Matt prides himself on fully understanding his clients’ problems, and assisting them tirelessly in achieving the best possible outcomes.

Matt earned his Juris Doctor degree with honors from the University of Texas at Austin in 2009. Prior to joining Wittliff Cutter, he served as associate and senior counsel for eight years in Bracewell LLP’s Austin office, and as counsel and senior counsel for five years in the Austin office of Pillsbury Winthrop Shaw Pittman.

  • iRobot Corporation v. Shenzhen Silver Star Intelligent Technology Co. Ltd., et al. (337-TA-1057) Counsel for Shenzhen Silver Star Intelligent Technology Co. Ltd. and its multiple downstream clients in a six-patent case concerning robotic vacuum.
  • SEVEN Networks LLC v. ZTE Corporation, ZTE (USA) Inc., et al. (U.S. District Court for the Northern District of Texas) – Counsel for ZTE in a seven-patent case before Judge Lynn concerning mobile communications and devices. 
  • Nautilus Inc. — represented Nautilus Inc. in a lawsuit accusing Icon Health & Fitness Inc. of breaching patent license and failing to pay royalties owed on a Chinese patent. 
  • Cybex International Inc. — represented Cybex International Inc., a leading fitness equipment manufacturer, against claims of misappropriation of trade secrets and unfair competition. 
  • CA, Inc. — asserted patents-in-suit on behalf of CA Inc. against competitor New Relic Inc.
  • Hewlett-Packard Co. — represented Hewlett-Packard Co. in multi-district litigation against claims of patent infringement involving 23 asserted patents-in-suit allegedly covering IEEE 802.11 a/b/g technology. 
  • Slyce Acquisition — represented Slyce in multiple patent infringement matters involving mobile visual search technologies. 
  • Paradigm B.V. and its subsidiaries — defended patent infringement claims relating to the company’s oil and gas exploration software. 
  • Freescale Semiconductor — prosecuted patent infringement cases involving semiconductor circuits before the International Trade Commission. 
  • BMC Software — represented BMC Software in patent litigation involving network management software. 
  • Academy of Allergy & Asthma in Primary Care and United Allergy Services in prosecuting claims of federal and state antitrust violations and tortious interference with contract. 
  • RetailMeNot – represented against claims of breach of contract and misappropriation of trade secrets and in asserted counterclaims for bad faith trade secret claims asserted by Wishabi (District of Delaware).
  • Versata Software, Inc. — represented Versata Software, Inc. against Configit in case involving allegations of trade secret theft in the Western District of Texas, Waco Division. 
  • ESW Holdings, Inc. — represented ESW in five patent case against Roku involving streaming media technologies.
